Loyalty Rewards Terms and Conditions:

Rewards Points:

The Rewards Points program is brought to you by directmachines.com. We are excited that you have chosen to do business with directmachines.com and hope you find value in the Rewards Point Program (“the Program”). Your participation in the Program is subject to the following policy guidelines, as well as all other applicable terms, conditions, limitations and requirements (“Terms and Conditions”). By enrolling and continuing to use the Program, you accept these terms, conditions, limitations and requirements. At any time and without noticedirectmachines.com may make changes to these Terms and Conditions or terminate the program. If you have questions about the status of the Program or your eligibility to participate in the Program, you may contact customer support.

Eligibility Age:

Program membership is open to individual U.S. residents (50 states, DC and Puerto Rico) at least 18 years of age.

Resellers:

Resellers may not earn or redeem Rewards Points and are excluded from the Program. If directmachines.com mistakenly issue points for resale purchases, directmachines.com reserve the right to deduct those improperly awarded points and/or to invalidate improperly issued reward certificates as well as to terminate such accounts. Determination of reseller status is made at our sole discretion. If directmachines.com determine you to be a reseller, your account may be terminated in accordance with Section “Membership Cancellation” below.

Active Account:

To remain eligible for the Program, you must maintain an active account. Account activity means a qualifying purchase made while logged in to the web site. To receive Rewards Points and information and updates about program changes, you must provide and maintain a valid e-mail address and promptly update your account with any changes and you acknowledge that directmachines.com will communicate with you about program changes, rewards and promotional materials. At any point in time, if you have not purchased from the web site in 12 months or more, directmachines.com reserve the right to terminate your account and you will forfeit the right to any points previously earned. Points forfeited for lack of activity will not be reinstated when account activity resumes. Points may not be transferred from one account to another.

Your status as a Rewards Points member begins as soon as you create an account and make a purchase, there is no waiting period. Reward Points are tallied automatically and you can view your available Rewards Points by accessing the My Account link and logging in (https://www.directmachines.com/customer/account/login/).

Receiving Points:

You may receive points only on products you purchase on the website.  At times, directmachines.com may identify certain products and offers that are not eligible for the Program.

Non-Qualifying Purchases:

Purchases made prior to account activation, instant rebates, pre-orders at the time of initial order (the points will be awarded at the time of final payment or at the time your product ships), purchases made for resale, store credit issued by directmachines.com, sales tax, service charges,  other excluded charges, and certain items that are excluded in particular promotions.

You will not earn Rewards Points for purchases made using Guest Checkout or any anonymous checkout methods. No Rewards Points will be granted after the time of checkout or for any past purchases.

From time to time, you may also receive bonus Rewards Points for taking specific actions for example, to purchasing a specific combination of products or referring others to the Web Site via social media. . When available, these bonus Reward Point opportunities will be noted on the website.

Redeeming Reward Points:

You will receive $2 for every 100 Rewards Point used. This rate is subject to change at any time without notice.

To redeem your Reward Points, you will be given the opportunity to apply them during the checkout process. The reward value will then be deducted from your total purchase amount and be noted on your transaction summary.

Membership Cancellation:

You may cancel your membership in the Program at any time by e-mail, [email protected]. If your membership is canceled (either by you or by directmachines.com), you will forfeit any remaining Reward Points.

directmachines.com may decline to issue or revoke any Rewards Points if directmachines.com terminate your account because of conduct that directmachines.com determine, in our discretion, violates these Terms and Conditions or any applicable law, involves fraud or misuse of the Program, or is harmful to our interests or another customer. directmachines.com also reserve the right to deny future membership if directmachines.com deem your conduct to violate these Terms.

Our failure to insist upon or enforce strict compliance with these Terms and Conditions does not constitute a waiver of any of our rights.

Limitations:

You may not transfer or assign your Program membership or earned Reward Points. Only one customer account will receive Reward Points for each transaction. Membership cards, Reward Points, and reward certificates have no cash value and may not be transferred. Additional restrictions may apply to directmachines.com employees.

Privacy Policy:

The information you provide as a member of the directmachines.com Rewards Points Program will be handled according to the directmachines.com Privacy Policy. If you are interested in learning more about directmachines.com privacy practices, see our online privacy policy. Occasionally, directmachines.com may test new products, services or promotions. Some of these tests may impact directmachines.com Rewards Points members and may vary from the terms of the Program.

Limitations of Liability:

In addition to other limitations and exclusions in www.directmachines.com conditions of use, see the information above, in no event will directmachines.com or our officiers, employees, agents or other representatives be liable for any direct, indirect, special, incidental, or consequential damages, or any other damages of any kind arising out of or tort (including negligence) or otherwise, will not exceed the total amount of the qualifying purchase that is the subject of the dispute, these exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your membership, directmachine.com's gross negligence, intentional, willful, reckless or malicious misconduct or fraud.

Jurisdiction of law:

The Program and any and all such claims brought against directmachines.com regarding any aspect of the Program shall be construed as and interpreted in accordance with its fair meaning and the laws of the State of Massachusetts. Any action regarding claims or disputes against directmachines.com or otherwise brought against directmachines.com by or on behalf of any directmachine.com employee, agents, assigns, heirs, administrators, or executors shall be maintained in court in Middlesex County, Massachusetts. If the claim could be brought in federal court, the action shall be maintained in the United States District Court for the  District of Massachusetts.

Other Terms:

directmachines.com may change these Policies or our Privacy Policy, or any aspect of the Program membership at any time with or without notice. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER directmachines.com CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

 

The Program and any and all such claims brought against Welding Supplies by IOC regarding any aspect of the Program shall be construed as and interpreted in accordance with its fair meaning and the laws of the State of Indiana. Any action regarding claims or disputes against WSIOC or otherwise brought against Welding Supplies by IOC by or on behalf of any Welding Supplies by IOC employee, agents, assigns, heirs, administrators, or executors shall be maintained in court in Marion County, Indiana. If the claim could be brought in federal court, the action shall be maintained in the United States District Court for the Southern District of Indiana.
